RIGHT OF WITHDRAWAL

If the Customer is a "Consumer", as defined in article 3 of the Consumer Code, he is entitled to the rights referred to in art. 52 and ss. of the Consumer Code, as amended by Legislative Decree of 21/02/2014 n. 21, and therefore the right to withdraw from the Purchase Agreement (hereinafter "Right of Withdrawal") for any reason, without motivation and without any penalty.

The Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the Goods purchased.

To exercise the right of withdrawal, the Customer must send a notice of withdrawal within 14 (fourteen) days from the day on which the Customer or his / her delegate acquires physical possession of the products purchased by signing the withdrawal.

Pursuant to Article 59 of Legislative Decree 06/09/2005 n. 206 (Consumer Code), the right of withdrawal does not apply to goods made to measure, personalized or which, due to their structure, cannot be returned, risk deteriorating rapidly or can be damaged. In the event that the product on sale falls into one of the cases referred to in art. 59 described above, the Site will report this indication with the phrase "Right of withdrawal not applicable" both in the product sheet and in the pages of the purchase procedure and in the order confirmation emails. Customers are invited to always check the presence of this wording.

Following the correct exercise of the right of withdrawal, the Customer will receive all the instructions to return the Products on the e-mail address declared during registration: the file number, the labeling to be applied to the packages, and the address to to return the Products (or the contact details of a forwarder with whom to arrange the collection).

Pursuant to art. 57 of the Consumer Code, the return of the Products to the seller must take place without undue delay, and in any case no later than 14 (fourteen) days from the date on which the Consumer communicated his decision to withdraw. The date of receipt of the notice of withdrawal by the Seller and the date of acceptance of the Product by the post office or the date of taking charge of the goods by a forwarder will prevail.

If the Customer has exercised the right of withdrawal in accordance with the provisions of these conditions, the Seller, in accordance with art. 56, paragraph 1 of the Consumer Code, will fully reimburse the sums paid by the Customer during the purchase, including shipping costs. The refund of the sums will take place through the same instrument adopted by the Customer during the payment phase, without undue delay and in any case within 14 (fourteen) days from the day on which he is informed of the consumer's decision to withdraw from the contract pursuant to Article 54. The Seller may withhold the refund until it has received the goods or until the Customer has demonstrated that he has returned the goods, whichever occurs first. The consumer will only bear the direct cost of returning the goods.

The returned goods must be returned in resalable conditions, preferably in their original packaging and accompanied by any accessories. Pursuant to the Consumer Code, the Customer is responsible for the decrease in the value of the products resulting from the handling of the products themselves other than that necessary to establish the nature, characteristics and verification of the functioning of the goods. In this case, the Seller reserves the right to ask the user to refund the decrease in value found. Therefore, even if a form of insurance on the return of goods due to the exercise of the right of withdrawal is not required by law, the customer is invited to adopt it.

Cancellation of the purchase order

The Customer who wishes to cancel his Purchase Order may proceed with its cancellation within the first 24 (twenty-four) hours of its issue. After the first 24 hours, the cancellation of Orders still in the payment phase, and the cancellation - even partial - of the items ordered and not yet reached the "processing" phase (therefore still in the "acceptance" phase) will be allowed.

Cancellation according to the terms set out in point 8.1 will take place at no additional cost and Italian Design Outlet will refund the customer the full amount paid. For the status of the Order and the items ordered, the indication given in the Customer's Order Area will prevail.

Complaints on products in case of discrepancies

Should the Customer encounter problems relating to the products received, he has the right to contact the Seller's assistance service, within 3 (three) days following the Delivery, to contest any discrepancies in the order, incorrect items, damaged or defective items, missing parts.

The return of the defective goods will involve the replacement of the same. The Seller will be entitled to opt for a monetary refund as an alternative to replacement.

The replacement procedure is initiated upon receipt of the documentation produced by the Customer, accompanied by photographic material that describes the damage claimed. The Customer is advised to keep the original packaging and the delivery document.

The Seller will contact the Customer within 3 working days in order to reduce waiting times and provide every detail for the return of the purchased products, with particular reference to the place of destination of the return and wording to be affixed on the packaging.

For the return of the return it will be the Customer's responsibility to properly pack the parts in their original packaging to avoid damage.

The production and subsequent shipment of the replacement goods will take place immediately after receipt of the return. The replacement of a product or part of it may require the same delivery times and delivery methods indicated in the purchase order or higher.

The costs of returning the products as described in the points of this chapter will be borne by the Seller.

SHIPMENTS: DELIVERY OF GOODS

Deliveries are made to the postal address indicated by the Customer during the purchase procedure stored in the Purchase Order. The Customer is responsible for the address provided. The Seller will not be liable for any errors in shipment or incorrect delivery of the products due to inaccuracies or incompleteness in the completion of the purchase order by the Customer.

Italian Design Outlet makes deliveries all over the world on request. However, some products may not be available for delivery in all regions. Through a preselection of the country based on the IP address, or through a drop-down menu, the user is able to view the products on sale in each country and the relative shipping costs. The availability of shipping in the geographical area indicated by the user is always confirmed in the purchase form.

Delivery times are indicated on the Site in the form of a range of dates (minimum date-maximum date), taking into account the production times of the product and the shipping times of the goods. The Site calculates delivery times based on the location of the Customer's browser and assuming that payment for the order is made by credit card (the fastest form of credit). Following the completion by the Customer of the Order form with details on the place of delivery and the method of payment, the Site will refine the calculation of delivery times in real time. Deliveries are made by the freight forwarder deemed most suitable for the type of goods and shipping area. Indicatively, shipping times vary from 2 to 5 working days for Italy, from 3 to 6 days for European countries and from 8 to 10 days for other destinations. Times may vary up to 30 days for particular products, or waits due to the producers of the goods.

In case of payment by bank transfer, Italian Design Outlet will take charge of the order only after verification of the payment. Therefore, the waiting times for accreditation will be added to the delivery times indicated in the Order Summary email.

Delivery will be made by courier between 08.00 and 18.00 from Monday to Friday. The Carrier will do n. 1 (one) attempt to deliver the Products in the case of national shipments and n. 2 (two) delivery attempts in case of international shipments to the address indicated by the Customer. In case of absence at the first Delivery, the Carrier will leave a notice of passage at the address of the recipient stating that an attempt has been made to make a delivery (or two in the case of international shipments). After the unsuccessful attempt, the Carrier will contact Italian Design Outlet to agree on the next correct action in compliance with the provisions of art. 1690 cc The Products will be kept free of charge by the Carrier itself for n. 5 (five) days (calendar). After further n. 20 (twenty) days (calendar) of storage the Order will be automatically canceled pursuant to art. 1456 cc and Italian Design Outlet will reimburse the Customer for the value of the Order, except for the costs of delivery and subsequent custody / deposit, which will be borne by the Customer. The termination of the contract and the refund amount will be communicated to the user via email. The refund amount will be credited to the payment method used by the user for the purchase or by bank transfer.

Unless otherwise indicated at the time of purchase, the products sold by Italian Design Outlet provide for standard delivery to the street level. Italian Design Outlet does not carry out the product installation service.

At the time of Delivery, the presence of the Customer or a trusted person is required to check that the packaging is intact and clean and that the Products received correspond to what is stated on the Order.

The risk of loss or damage to the goods, for reasons not attributable to the Seller, is transferred to the Customer only when the latter, or a third party designated by him and different from the Carrier, materially comes into possession of the goods.

Italian Design Outlet will not be liable for damage to the products or for any shipping delays occurring after delivery to the carrier in charge of their transport.

In case of defects immediately detectable on delivery, such as the number of packages not corresponding to the order or the non-integrity of the packaging, the Customer (or the person in charge of collecting the goods) is required to make an immediate report in writing. to the Carrier (withdrawal with reserve) and to contact the Seller through the platform within 3 (three) working days from the delivery date.

For purchases in which the country of the Seller who ships the goods and the country of the Customer who receives it are different, additional customs duties may be applied at the time of delivery of the goods. In this case the product sheet will report a warning. Customs policies vary considerably from country to country, for this purpose the customer is invited to contact the customs office of their country to check any additional taxes.

In case of delays or non-delivery of the purchased goods, the Customer can inform the Seller through the link "Contact us" in Help & More. The Seller undertakes to contact the customer within 3 (three) working days.

The Seller cannot be held responsible for any delays in shipping or impossibility of delivery due to: national or local scheduled holidays, strikes, riots, natural disasters, transporter accidents, thefts, robberies. If the cause of force majeure persists beyond a period of 3 (three) months, the order will be automatically canceled.

Any delays in deliveries of less than 30 (thirty) days do not entitle the customer to refuse delivery of the products, nor to claim compensation or compensation of any kind. In the event that it is not possible to communicate to the Customer a reliable delivery date, Italian Design Outlet will be entitled to propose to the Customer the cancellation of the order, at no additional cost and with immediate refund through the means of payment chosen by the Customer at the time. of the order.

Product warranty

All products sold are covered by the "Legal Guarantee" of Conformity provided for by articles 128-132 of the Consumer Code.

The guarantee on the product will be exercised in the ways and within the times provided for by the law directly by the manufacturer.

By virtue of the "Legal Guarantee" the Manufacturer is responsible for any lack of conformity which occurs within 2 (two) years from the Delivery of the Product.

The legal guarantee provides that the Consumer, under penalty of forfeiture, denounces to the Manufacturer any lack of conformity found in the product purchased within 2 (two) months of discovery (Article 132, Consumer Code). Following this complaint, the Consumer will have the right to request the repair or replacement of the Product, without prejudice to the other rights provided by law in favor of the Consumer.

Products repaired, modified or altered in any way by the user are excluded from the Legal Guarantee. Also excluded from the scope of the Legal Guarantee are any faults or malfunctions or defects of any other type caused by accidental events or by the user's responsibility or by a use of the product that does not comply with its intended use and / or as provided in the documentation. technique attached to the product, if any, or in the instructions for use relating to the same.

The Legal guarantee in this case is valid for a maximum term of 12 (twelve) months from the Delivery of the Product and provides, under penalty of forfeiture, to notify the Seller of any defect found in the product purchased within 8 (eight) days of discovery. .

LIABILITY OF Italian Design Outlet

Italian Design Outlet will not be liable in the event of loss of revenues, profits, data or any other indirect damage of any nature deriving from or otherwise connected to contracts subject to the General Conditions.

The responsibility of Italian Design Outlet for platform malfunctions such as: incorrect receipt of the purchase order confirmation due to blocking of the e-mail service, cyber attack, denial of service cannot in any case be economically greater than the total value of the order. purchase made.

The responsibility of Italian Design Outlet in relation to the sale of products through the platform, without prejudice to the hypothesis of willful misconduct or gross negligence, can never exceed the price paid by the Customer.
